KEYNOTE TOPIC SUMMARY

Do you have plans to manufacture or sell goods or services in China? You may be aware of rumors of rampant pirating in China, and you may have encountered pirated copies of various kinds made in China and exported to other parts of the world. Have you considered what can be done to protect your own products and/or services from unauthorized appropriation by the Chinese?

The lure of the Chinese market may be irresistible but unless you are properly prepared before you enter it, you may not profit from the full potential benefit of participating in that market. This seminar is intended to give you the advantage of a more intimate knowledge of both the strength and the limitations of IP rights in China, which may play a pivotal role in your decision to participate as well as your company's ability to succeed in the Chinese market.

The topic of enforcement of IP rights in China will be addressed in a seminar presented by:

  • Mr. Jiancheng Jiang, managing partner and an experienced patent agent and attorney from Peksung Intellectual Property Ltd., Beijing, who will speak on patent enforcement in China. Mr. Jiang was recently involved in an invalidation procedure of a Viagra application in China, representing the applicant; and
  • Mr. Tingxi Huo, an experienced trademark attorney from Peksung Intellectual Property Ltd., Beijing, who will speak on trademark procurement and enforcement in China.

You will learn whether Chinese patents and registered trade-marks are useful deterrents against unauthorized copying and what role each one should play in your IP strategy. You will also learn how to obtain and enforce your intellectual property rights in China, what limits and pitfalls exist, and how to leverage existing provisions in the Chinese patent and trademark laws to your best advantage.


ABOUT THE SPEAKERS

Jiancheng Jiang is the managing partner at Peksung Intellectual Property (IP) Ltd., a firm that he founded in 2003. His area of practice includes: patent application drafting; prosecution and reexamination; patent invalidation; licensing and transfer; strategy in intellectual property matters, in main technical fields, particularly in the fields of biochemistry, biotechnology, pharmaceuticals, and organic chemistry. Prior to founding Peksung IP Ltd., he practiced IP law at China Patent Agent (HK) Ltd., where was the assistant general manager responsible for all patent-related affairs. He holds a Bachelor of Science from Peking University and a Masters of Science from the Chinese Academy of Science in Beijing. He has studied patent law in Europe and the U.S. Currently, he is studying for his LLM at the China University of Political Science and Law (CUPL), Beijing, China.

Tingxi Huo joined Peksung Intellectual Property Ltd. in 2004 where he specializes in trademark prosecution, opposition, cancellation and infringement before the Chinese Trademark Office (CTMO) and the Trademark Reexamination and Adjudication Board. He also consults on corporate trademark strategy, copyright protection and trademark prosecution in Hong Kong. Prior to joining Peksung Intellectual Property Ltd., he practiced Chinese and Hong Kong IP law at China Patent Agent (HK) Ltd. He holds a Bachelor of Arts from Henan University and is studying for his LLM at the China University of Political Science and Law in Beijing.
